Today I bring you one case. One very horrific case that will most likely never see the inside of a courtroom. This is a case of domestic violence that turned to murder and now, despite his requests for death, the perpetrator has been declared incompetent to stand trial.  The case I bring to you is a case from here in Florida (yes all the good shit happens here). It is the case of Mesac Dumas.

Police believe the murders were committed on September 17, 2009 however the signs of abuse IITM2and the warnings for Guerline Dieu to leave her husband came back in 2005. The first reported allegations of abuse came on June 6, 2005 and spanned about 2 years. Most of the allegations were dropped. One charge however did stick. On January 6, 2007 the state of Florida brought misdemeanor battery charges against Mesac. On June 1 of that year he pled no contest which means he doesn’t have to claim the charge (job applications) but he was sentenced to 12 months probation, 200hrs community service and a $600 fine. He also had to attend a battery class and parenting class.

IITM3Though the family was receiving assistance from DCF after the claims of violence and sexual abuse were filed by Mrs Damas and charges were brought against Mesac. According to the social worker, the family was progressing well even tho one of the children told the investigator that his father beat him and would not allow him to call the police or seek help and would lock them in the house if they tried and would hurt them more if they tried to report the abuse. Services were being given after the January 6, 2007 charges were brought against Mesac. In the police report Guerline alleged Mesac hit her about the face with an open hand and choked her causing her to drop their baby on concrete. When the police were asking questions one of the children volunteered that “daddy was hitting mommy”. Mesac was found later at another apartment complex. Guerline did not want to leave Mesac and despite of the fact that DCF felt there was “overall risk” they did not remove the children from the home and allowed Mesac to stay at the residence.

On September 17, 2009 just before 9pm Mesac left his shift at Miller’s Ale House and police IITM5believe he went home. They believe he then went home and bound his wife, stabbed her, and slit her throat. He then did the same to all 5 of their children. Michzach, 9, Marven, 6, Maven, 5, Megan, 3, and Morgan Damas, 11 months all had been stabbed and their throats slit. Their mother was found in the bathroom on the first floor. Michzach was found in a bedroom on the second floor, and the rest of the children were found in another bedroom on the second floor. The next morning Mesac took a flight from Miami to Haiti. He was arrested there a few days later and brought back to Florida. He said he planned on turning himself in but only went to Haiti to say goodbye to his family.

Mesac’s father said that if his son was guilty he should face the electric chair. The police who found the bodies and collected evidence were sent to counseling due to the horrific scene that they came upon. Even those who weren’t allowed on the scene but viewed the evidence video of the walk through were sent to counseling to help deal with what they saw in the video.

IITM6So what would cause someone to do this to their whole family? No one knows. Mesac Damas has never said anything as to why he decided to slaughter his whole family in one of the most gruesome ways possible. In a statement made by Mesac to reporters, he said he was possessed by demons at the time of the murder. He blamed his mother in law and whatever she worshiped as to his reasoning. Saying that whatever she worshiped had taken over him and caused him to do it. He also said he was going to kill himself but couldn’t bring himself to it because if you do then you don’t go to heaven and he wanted to join his family in heaven so he wanted to be executed immediately so he could be buried with his family. His defense is going for an insanity defense and has requested competency hearings. 2 out of 3 of them have declared him incompetent to stand trial. He has asked the judge more than once to represent himself saying that he doesn’t need lawyers, God is his lawyer. He has also disrupted hearings with singing and outbursts telling the judge and the gallery that they need to seek Jesus.

Here’s what will happen if he is not found competent… if not found competent in 5 years the IITM7charges against him will be dropped! However there is no statute of limitations for murder charges. While the judge has ordered Mesac Damas to a mental health facilty, he will only be there until he is found competent to stand trial. However, that may never be the case as long as he continues to email reporters saying that he was possessed at the time of the murders. If he is ever found competent the charges can be brought back but as of right now he is going to be hanging out at a mental health facility living off the the state and getting free health care.

Family Slain FloridaUnfortunately for this family, a woman’s love for her husband cost her the life of her family and herself. She failed herself and her family. But they were also failed by the system that allowed Mesac Damas to reside with them after claiming they were at risk. While some claim that Florida allows white people to walk when they murder black children it seems that Florida is allowing a black man to walk when he murders his whole family. I don’t see anyone marching to get justice for the family in this case. I don’t see anyone screaming for justice here. A man massacred his family in a way that scarred the police and yet he will be sitting around eating pudding all because he decided to quote the bible in the middle of court proceedings.

Every 9 seconds a woman is assaulted or beaten in the United States and everyday more than three women are murdered by their husbands or boyfriends. If a man witnesses abuse as a child he is twice as likely to abuse his own wife or girlfriend than those of families without domestic violence. *These facts are from Domesticviolence.org
